10 Major Mistakes in Workplace Investigations

Ah, the good old “workplace investigation.” Never hurts to have another posting on this subject, eh? In this posting, I address ten major things to avoid in conducting a workplace investigation, as described by Rothgerber, Johnson, & Lyons. Here are some of what I think are the most interesting of the ten major mistakes:



Promising to Limit the Disclosure of Information Obtained From Witnesses During an Investigation

Prejudging Prior to or During an Investigation

Failing to Warn About Protection From Retaliation

And, last but not least:

Failing to Conduct Any Investigation.

This article notes that:

Courts have found that no investigation can be evidence that the employer acted with “malice or reckless indifference” to the employee’s federally protected rights.
