Sun Rises In the East: Employment Law Keeps Attorneys Busy!
Recent reading suggests that employment law is keeping attorneys quite busy! The Corporate Counsellor (subscription only) reported a recent survey of U.S. litigation trends, based on responses from 300 corporate counsel, that provides some interesting findings. In particular, what do you think was the #1 litigation fear? Your choices include product liability, intellectual property, and so forth. If you said
labor and employment issues, you were right! Yes, labor and employment issues beat out contract disputes (#2) product liabiilty (#4), intellectual property (#3), and class actions (#5).
One more interesting finding from the survey: cost was a distant fifth factor in how companies choose outside counsel. The #1 factor was case experience, followed by related things, such as knowledge and reputation. Cost cutting is, apparently, not a major factor in choosing outside counsel.
A recent article in Legal Times (most articles available by subscription only) points to some anecdotal evidence regarding the importance of employment law. In this story, a law firm used “legal intelligence” as a business development strategy. Specifically, this Chicago-based law firm approached a potential client with the hope of gaining their business, by consolidating all of their outside counsel needs. According to the article, the CEO of the potential client didn’t realize that 70% of the cases against them were over employment law issues! The artice continues by saying that the 5 largest growth areas in federal civil litigation include employment suits.
