Mental Illness and ADA: A Management Challenge

Often not visible, sometimes perceived as “the person’s fault,” mental disabilities appear to be one of the more challenging aspects of ADA. As noted in this article from HR Executive magazine, the obvious “not all mental illnesses are disabilities under ADA,” will hardly surprise anyone.

Some of the suggestions in this article for handling mental disabilities are good things to keep in mind:

Find out what the employee is requesting. Some employees aren’t asking for an accommodation.

Don’t feel obliged to provide a requested accommodation. “It’s simply a starting point for the dialogue,” says one expert.

Document any accommodations, no matter how trivial, that are provided.

Avoid stray comments in your documentation that indicate your belief that a disability exists.
