Get Spanked by your Employer, Win 1/2 million dollars!
April 28, 2006In a follow-up to our recent story about a company that included spanking of employees in its “motivational training,” a jury just awarded a spanked woman who sued this company $500,000!
According to the newspaper report, however, she had asked for over 1 million dollars in lost wages, medical costs, and damages.
I think the moral of the story for companies is: Spare the rod, spare some money in legal fees and lots of money in damages..
The moral of the story for employees is: Choose your employer carefully and find a good lawyer if you don’t like what they do!

UPDATE 1/18/08: Court Overturns $1.5M Spanking Verdict
[A] three-judge panel of the state Court of Appeal overturned that verdict, ruling that the jury had been given improper instructions. In particular, the jury wasn’t instructed that one vital element of proving that sexual harassment occurred is showing the action was directed at a woman because of her gender.

Medical expenses? Lost wages? How bad could this have been?
Stupid on the employer’s part, yes.
Unpleasant, maybe.
The stuff of nightmares, psychiatric disability, constructive discharge? Not from the facts in the news stories.
But half a million? Hopefully this will either be reversed or the damages cut way back.
I’m going to make sure this one makes it to overlawyered.com, where it most assuredly belongs as an example of over-litigated America. Puke . . .

Wowzie, this is Way over the edge.. What was meant to be team building and fun for the rest of the team was turned into a ..yikes!
