Worrying About Complying With New Internet Applicant Guidelines? OFCCP Issues Some Relief!

As you may know, the new OFCCP guidelines on Internet applicants are rather complex and there are many factors to consider. Give the looming deadline of February 6, 2006 for compliance with the new guidelines, you may worry whether your organization will be ready or not.

OFCCP has issued a new Q & A on this very issue. That Q & A states that while the OFCCP will not extend the date,

OFCCP will not cite a contractor for a purely technical recordkeeping violation for failure to comply with the Internet Applicant final rule, provided that the contractor (1) demonstrates that it is taking reasonable steps to update its systems to comply with the rule, including a projected date of compliance, and (2) collects and maintains records according to the established procedures consistent with OFCCP’s recordkeeping requirements that preexisted the Internet Applicant final rule, i.e., 41 CFR 60-1.12

Before you let out a big breath of relief, however, you should note that the “grace period” is only for 90 days following February 6, 2006. So, don’t get too comfortable!
