Hurry up and get your FMLA comments in!

The Family and Medical Leave Act (FMLA), while well-intended, has created some significant practical headaches for employers, particularly with regard to abuse of intermittent leave (perhaps that’s an understatement).

The following notice, which I received from Chris Reynolds, the Management Vice-Chair of the American Bar Association’s EEO Committee, highlights a unique opportunity to express your concerns by submitting comments as part of the regulatory process.

As you may be aware, the U.S. Department of Labor is currently taking comments until February 16, 2007 on the Family Medical Leave Act (”FMLA”), its implementation, effect, impact, etc.

As of this writing, 60 comments . . . have been posted on the website, linked below. Given the impact of the FMLA on all sides of the labor and employment bar, now is your opportunity . . . to let the DOL know about the issues and perspectives you and your clients have with the FMLA.

You can submit comments electronically through the link to http://www.regulations.gov.

Once you get to that site, click in the dropdown menus to “Department of Labor”, then “Proposed Rules” and hit “submit”. Then, in the search results, click on the document i.d. number ESA-2006-0022-0046.

You will see a screen with a yellow word balloon next to the words “Add Comment.” Click on that balloon and you will have access to a comment form. You may also submit comments of 20 pages or less by fax machine to (202) 693-1432 . . . or by e-mail to: whdcomments@dol.gov
