Is Compensation Discrimination Amendment Needed? (Fair Pay Act, Part 2 of 2)
Last week, in Part 1 of this series, I discussed the Supreme Court’s Ledbetter decision and the criticism of it that led to the introduction of corrective legislation in the form of the Fair Pay Act.
Today, in Part 2, I’ll cover some reasons why I believe the impact of Ledbetter on employees is not as harsh as critics claim, and why compensation discrimination is not as different from other types of job discrimination as they claim.
Transgender Employees: What’s an Employer to Do?
The following is a guest post provided by Dr. Jillian Todd Weiss, Associate Professor of Law and Society at Ramapo College, who researches this area, as well as consults with corporations and writes a popular blog on the subject, Transgender Workplace Diversity. She has now authored the new book described below, Transgender Workplace Diversity: Policy [...]
Authoritative Summary of Law on Family Responsibilities Discrimination
We’ve written before about the increased interest in what is being called “Family Responsibilities Discrimination”:
Family Responsibilities Discrimination?
EEOC Issues Guidance on Family Responsibilities Discrimination
Mommified: Social Science Evidence of Discrimination Against Mothers
Legally speaking, family responsibility discrimination does not involve a new form of prohibited discrimination in the workplace, but rather a set of scenarios that are increasingly [...]
Plain Speaking About Really Bad “Fair Pay” Bill
About a month ago, I wrote a post on the gender-pay gap for the Recruiting Blogswap, which was published by CollegeRecruiter.com under the title “The Gender-Pay Gap: How Much Progress from Sixty Cents on the Dollar? Is Legal Reform Needed?”
I said I didn’t think legal reform was needed; just enforcement of existing laws.
Now along comes [...]
EEOC Issues Guidance on Family Responsibilities Discrimination
Family Responsibilities Discrimination has been in the news a lot lately. I’ve been skeptical of the concept, drawing some interesting comments.
Katie Rice touched on a similar topic in her first post as an intern on this Blawg: Mommified: social science evidence of discrimination against mothers.
I’d thought we’d give the topic a rest for a [...]
Mommified: Social Science Evidence of Discrimination Against Mothers
Several weeks ago, “Equal Pay Day” rekindled discussions of pay inequality between men and women, highlighted by the release of a new study of the extent to which the pay gap reflects unlawful, gender-based discrimination.
George wrote a post on this topic for the Recruiting Blogswap, which was published by CollegeRecruiter.com under the title “The Gender-Pay [...]
A maternity clothing store discriminating against pregnant women?
At first glance, this story about a pregnancy discrimination claim against maternity clothier Mothers Work, Inc. is just one of those delightful ironies of employment law. I mean, surely such a company would always have the best interests of pregnant women in mind, even when they were job applicants, right?
On further reflection, however, [...]
Family Responsibilities Discrimination?
Subtitle: F.R.D. — “you can call it FRED."
Apologies to my regular readers for being scarce on this blog lately. I’ve been busy, with billable work and otherwise — and maybe also needed a break from the blogging routine.
One activity has been speaking to several reporters for major publications about my CollegeRecruiter.com guest post: “Employers Using [...]
When Bullying Becomes A Case of Sexual Harassment
Don’t get too comfortable too quickly when there is bullying in your workplace.
I’ve often gotten the impression that companies can relax when the bully doesn’t appear to be intending to discriminate against women (or men for that matter).
What seems to often be assumed is that as long as the manager or supervisor is [...]
Discrimination Because of “Sex” Isn’t Necessarily Sex Discrimination
Federal law (Title VII of the Civil Rights Act of 1964) prohibits discrimination because of sex.
Ever since this provision was interpreted to extend to sexual harassment, some confusion has been caused by two very different meanings of “sex”:
The condition or character of being female or male; the physiological, functional, and psychological differences that distinguish [...]
Wal-Mart Releases Diversity Information: But Is There Enough Information There?
One employment discrimination lawsuit that we have followed quite carefully in this blawg is Dukes v. Wal-Mart, with entries ranging from an analysis of the judge’s decision to grant class certification to a posting regarding an apparent attempt at settling the Dukes v. Wal-Mart sex discrimination class action case out of court.
Now, we note [...]
Latest Discrimination Class Action Target: Best Buy (will Target be next target?)
Best Buy has become the latest “big box” retailer to fall victim to the race discrimination and sex discrimination class action craze, joining the likes of Wal-Mart and Walgreens.
Six former and current employees sued Best Buy Thursday, “alleging the company has purposefully excluded women and minorities from top-paying jobs as part of a sales culture [...]
Did EEOC “Overlawyer” the Dial Corp. Employment Testing Case?
We’re always pleased when the popular Overlawyered blog links to us. Frankly, in the past those links have provided our biggest readership bounces.
So we were happy that Overlawyered picked up the story of the Dial Corp. case involving gender discrimination in strength testing, linking to our post “Dial To Pay $3M for Strength Test [...]
You’ve Come A (Really) Long Way, Baby!
Read some shocking advice from a 1943 transportation magazine about supervising women…have we come along way, baby?!?!?
HR/Employment Blogosphere Update for October 1-26, 2005
I’ve been so busy switching to the new format and keeping up with the “Our Recent Reading” page that I’ve neglected to do this update for over a month. (New readers: I had been doing it weekly, publishing on Monday, and it was a popular feature of this Blawg.)
So here comes a [...]
